Terms of Service

These terms govern your use of the Broadway Index website at bwayindx.com and the Broadway Index Pro service at pro.bwayindx.com (together, the "Service"). The Service is operated by Bwayindx LLC, a New Jersey limited liability company ("Broadway Index," "we," "us"). By creating an account or using the Service, you agree to these terms.

1. The Service

Broadway Index publishes a weekly performance benchmark for Broadway productions, with related data, rankings and analysis. Some content is public. Broadway Index Pro requires an account and, for paid features, a subscription. Licensed access for organizations is provided under a separate written agreement, which governs where it differs from these terms.

The Index is derived in part from publicly reported weekly box office figures. Broadway Index is independent and is not affiliated with or endorsed by The Broadway League or any production, producer or theatre owner.

2. Accounts and eligibility

Pro access is by invitation or waitlist. We may review requests and verify your professional role before offering a plan, and we decide which plans are available to which accounts. You must be at least 18 and able to enter a binding contract. Keep your sign-in secure; you are responsible for activity under your account. Accounts are for one person and may not be shared.

3. Subscriptions and payment

Paid plans are billed in advance, monthly or annually, through our payment processor, Stripe. Prices are shown at checkout. Subscriptions renew automatically at the end of each period until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current paid period. Refunds follow our Refund and Cancellation Policy. We may change prices with at least 30 days' notice before your next renewal. Prices exclude any applicable taxes.

4. Permitted use

Your subscription lets you view and use the Service for your own internal business or personal purposes. You may quote limited excerpts with attribution to "Broadway Index." Without a written license from us, you may not:

  • copy, download in bulk, scrape or systematically extract data from the Service
  • resell, redistribute, sublicense or publish the data, scores or rankings
  • use the Index as a reference rate or benchmark in a contract, financial product or pricing formula
  • use the data to build a competing product or to train machine-learning models
  • share your account or circumvent access controls, rate limits or security

5. Intellectual property

The Service, the Index methodology, scores, rankings, text, design and the Broadway Index, BWAYINDX and related marks belong to Broadway Index or its owner and are protected by intellectual property law. These terms grant no rights beyond the limited use in section 4.

6. No advice; accuracy

The Service provides information and analysis only. It is not investment, financial, legal or business advice, and no score or ranking is a recommendation to invest in, produce, book or close any production. Data may contain errors, be revised or be delayed, and source figures may be restated. Make your own decisions and verify anything material.

7. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. To the fullest extent the law allows, Broadway Index is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

8. Suspension and termination

We may suspend or end your access if you breach these terms, misuse the Service or fail to pay. If we end a paid subscription without cause, we will refund the unused portion of the current period. Sections 4 through 7 and 9 survive termination.

9. General

These terms are governed by the laws of the State of New Jersey, and disputes will be heard in the state or federal courts located in New Jersey. We may update these terms; material changes will be posted here with a new effective date and, for subscribers, notified by email at least 14 days before they apply. If any part is unenforceable, the rest remains in effect.
